The Secret of Vicarious Liability
The word “vicarious” usually sparks good or humorous thoughts. Maybe you feel that your parents live vicariously through you because your life is so fun, or it could be the other way around and you live vicariously through your parents because you wish you had your life planned out.
However, when it comes to
vicarious liability
it is likely things are different. This is one situation where it’s almost guaranteed that no one wants to be living through anyone. This can be an expensive place to be.
Vicarious liability works by requiring that parents take responsibility for their children’s actions. If a child is involved in a car accident and someone is injured, the child’s parents are liable. This may not seem fair because the parents of the child were not even in the vehicle, but it’s still that law.
So, how can this happen? Well, it is likely that a child driver (under the age of 18) is not financially stable enough to be held responsible for paying the accident bills. To keep from multiple lawsuits flooding the court regarding minors and car accident payments, this law was created. If the bills are not paid then the parents can be sued for the amount owed.
If you are a parent who currently has a child under the age of 18 and they are not insured, you might want to reconsider. Some parents forget that they are responsible for their child’s driving behavior even if they aren’t present in the vehicle.
